Introduction

The property owner, Château La Carrière, La Carrière, Saint Cyprien, Dordogne, 24220, France, is also referred to as "we" and "us". The holidaymaker is the person who signs the booking form or, in the case of an online booking, the person who makes the online payment. This person is responsible for ensuring all members of the holiday group accept and adhere to these Terms & Conditions. The holidaymaker is also referred to as "you". When booking, the holidaymaker enters into a legally binding contract between him/herself and the property owner.

 

Bookings/Payment policy

A 40% non-refundable booking deposit is payable within 1 day of the provisional booking being taken. The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled at any time without prior notice. The balance of the rental charge, along with the breakage deposit, is payable not less than 12 weeks prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued. Bookings made less than 12 weeks prior to the arrival date must be paid in full at the time of booking.

 

Cancellation by the holidaymaker

Any cancellation by you (for whatever reason) must be sent in writing. The effective date of cancellation is the date on which we receive the written notification. Cancellations sent by email are only valid if the email is indeed received and acknowledged by us. Cancellation of the booking by the holidaymaker should be made by email to info@chateaulacarriere.com. In the event of a cancellation, the following cancellation policy comes into force: If you cancel more than 12 weeks prior to your arrival date or you refrain from making the final payment during the 12 weeks before your arrival date, you will only lose your booking deposit. If you cancel 12 weeks or less prior to your arrival date, you will lose all payments made. However, if you cancel due to exceptional circumstances, such as sickness, after paying the full amount, we will endeavour to obtain a replacement. If we are successful, we will refund your balance, less any charges for finding the replacement as well as transaction fees. We strongly recommend you take out holiday cancellation insurance.

Postponement by the holidaymaker

Bookings cannot be postponed by the holidaymaker. However, in exceptional circumstances and solely at the owner’s discretion, holidays can be moved to a later date. If so, the following terms and conditions apply. Communication of a postponement of a holiday should be made and is acknowledged in the same way as a cancellation (see above). In case of a postponement to a later date of which the rental price is more expensive than the original booking, the holidaymaker will need to pay the difference between the new and the old rental price, including the non-refundable deposit. Postponing of a holiday can only made once. After that, it is regarded as a cancellation. Please note that in case of a postponement, the holidaymaker needs to agree to the current Terms & Conditions, which may have been updated in the meantime. 

Cancellation by the property owner

The property owner will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event the property becomes not available and the property owner has to cancel the booking, the property owner will endeavour to find the holidaymaker suitable alternative accommodation. If suitable alternative accommodation cannot be found, the holidaymaker shall be entitled to a full refund. The property owner shall only be liable to return the monies received. No compensation or consequential losses shall be paid.

 

Miscellaneous

Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies. The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required. The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner's opinion, the behaviour of the holidaymaker and/or his/her group is unacceptable. The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable to or capable of taking charge of the property. The property owner reserves the right to ask the holidaymaker and their group to leave the property, without refund, should the behaviour of the holidaymaker and/or their group be considered by the property owner to be unreasonable.

 

Number of guests

The maximum number of people, children (younger than 18) and infants (younger than 3) entitled to stay at the property is 16, 8 and 2, respectively. In advance of your stay, we will ask you for a list of names of those who intend to stay at the Château. Only those people named on this list are entitled to stay at the property and make use of its facilities. It is not allowed to invite new people halfway your stay, even if the total number of people staying at the Château does not exceed 16. It is not allowed either to invite people for the day to make use of the facilities of the Château. If it is found that more or other people than agreed are staying at the property or making use of the facilities, this will be considered a breach of contract and the holidaymaker and his/her group will be asked to leave immediately without any refund. Sub-letting or assignation of the let is prohibited. 

Smoking

It is prohibited to smoke inside Château La Carrière. If it is found that you or a member of your group smokes or has smoked inside, this will be considered a breach of contract and you and your group will be asked to leave immediately without any refund.

Candles

Candles placed inside the house are for decorative purposes only and are not to be used or moved outside.

Fireplace

After using the fireplace, you and your group are requested to put the ashes in the metal bin located in the storeroom. 

 

Pets

Pets are not allowed. If it is found that you or a member of your group has brought a pet, this will be considered a breach of contract and you and your group will be asked to leave immediately without any refund.

Parties and celebrations

The holidaymaker is obliged to ask permission from the property owner to organise any parties or celebrations on the premises of Château La Carrière (this includes the hire of third-party entertainment). The holidaymaker is prohibited from inviting people to such parties or celebrations that are not guests sleeping at the Château (and were not listed on the original reservation).   

Arrival and departure time

Every effort will be made to have the property available from 17:00 on the day of arrival. The property must be vacated by 10:00 on the day of departure. The pool, pool house and lake house are not to be used after 8:00 on the day of your departure. The bedrooms must be vacated by 9:00, so our cleaning staff can start working. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided once full payment has been received.

 

Liability

The property owner takes no responsibility for the personal possessions of the holidaymaker or the holidaymaker's group. Vehicles and possessions are left entirely at the risk of the holidaymaker. Children must be supervised at all times and are not allowed to drive the golf car or operate any equipment. Walking around and playing in close proximity of the lake, as well as swimming in or playing in close proximity of the pool (which is equipped with two alarms) is at the responsibility of the individual or his or her parents or supervisors. Château La Carrière and anyone working alongside us will not be liable for any injury, damage or loss of any nature, however caused (through negligence or not) suffered by you or your group whether before, during, or after your stay. 

Cleaning

We would like to think the holidaymaker and his/her group will treat the property as they would their own home and that at the end of the holiday the property is left in a clean and tidy condition. On departure, all rubbish, including recycling, needs to be put the designated wheelie bins in the storeroom; glass needs to be put in the trays provided in the storeroom; crockery, cutlery and glassware needs to be cleaned and stored away or put in the dishwasher; fridges and food storage areas need to be emptied; the barbecue needs to be cleaned properly; all rooms, terraces and other areas in the garden, including the pool, need to be left in a tidy condition; used towels need to be left in the baths, gym towels need to be left in the gym shower, and pool towels need to be returned to the Pool House; furniture (indoor & outdoor) that has been moved needs to be put back to their original position; ashes in the stove or chiminea need to be removed and put into the metal bin in the store room; and all games and toys need to be put back the way they were found. Should the property be left in a disproportionally dirty or untidy condition, then the property owner retains the right to withhold (part of) the breakage deposit, which under normal circumstances amounts to €500.

 

Breakages

The holidaymaker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the property owner (or their representative) prior to departure. The property owner retains the right to withhold some or all of the breakage deposit to cover the costs. Although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the property owner) will not be charged for.

Lost Property

We are happy to return items that have been left following departure. However, there will be a minimum charge of €10.00 to cover postage and packaging.

Changes

We reserve the right to change our prices at any time. This does not affect bookings already made. 

Complaints

Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from to time things do go wrong. In these circumstances, it is the responsibility of the holidaymaker to make any such problem known to the property owner (or their representative) immediately it becomes apparent, thereby giving the property owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained. The property owner will make every endeavour to rectify any identified problems as soon as is reasonably possible.

 

Insurance

Personal travel insurance cover is not included within the holiday booking fee. We strongly recommend our guests ensure that their group is adequately insured through a travel insurance and cover for the duration of their stay with us at Château La Carrière.
